§ 6-44. Applicant considerations.

  • In determining whether or not any license applied for under this section shall be granted, the following, among other things, shall be considered as being in the public interest and welfare:

    (1)

    The applicant's reputation, character, and mental and physical capacity to conduct the business.

    (2)

    Any evidence of financial irresponsibility involving the applicant's past failure to pay all state and local taxes associated with any business selling alcoholic beverages.

    (3)

    If the applicant is a previous holder of a license to sell alcoholic beverages, whether or not applicant has violated any law, regulation, or ordinance related to such business.

    (4)

    If the applicant is a previous holder of a license to sell alcoholic beverages, the manner in which the applicant conducted the business under such license as to the necessity for unusual police observation and inspection or intervention in order to prevent or curtail the violation of any law, regulation, or ordinance relating to such business.

    (5)

    The location for which the license is sought as it might effect traffic congestion; the general character of the neighborhood, and the effect such an establishment would have on adjacent and surrounding property values.

    (6)

    The number of licenses already granted for similar businesses in the trading area of the place for which the license is sought.

    (7)

    Whether the applicant is a person who has previously held a license issued under the police powers of the county that has been suspended or revoked.

    (8)

    Whether the proposed location is in compliance with all state and local building and health related codes.

    (9)

    Whether there is adequate ingress and egress from the location to the nearest public thoroughfare.

    (10)

    If the applicant is a non-resident of the county and designates a resident to deal with all matters involving the license whether or not the person designated meets all the requirements of an original applicant.
