§ 34-98. Penalties for violation.

  • (a)

    Violations. Violation of the provisions of this article or failure to comply with any of its requirements shall constitute a misdemeanor. The owner or tenant of any manufactured home and any dealer, builder, installer, contractor, agent or other person who commits, participates in, assists in, or maintains such violation may each be found equally guilty of a separate offense and be subject to the same penalties as mentioned below.

    (b)

    Penalties. Any person who violates this article or fails to comply with any of its requirements shall, upon conviction thereof, be fined not more than $1,000.00 or imprisoned for not more than 60 days, or both, and in addition shall pay all costs and expenses involved if ordered by the court.

    (c)

    Nuisance. Any violation of any provision, requirement, term or condition of this article shall constitute a nuisance and any person aggrieved thereby may abate the same or the same may be abated as a public nuisance. Continuous violation thereof may be restrained in a court of equity having jurisdiction thereof.
