§ 14-14. Forfeiture.

  • In addition to all other rights and powers reserved or pertaining to the county, the county reserves as an additional and as a separate and distinct remedy the right to revoke this franchise and all rights and privileges of the grantee in any of the following events or for any of the following reasons:

    (1)

    The grantee fails after 30 days' prior written notice to comply with any of the provisions of this chapter or has, by act or omission violated any term or condition thereof;

    (2)

    Any provision of this chapter shall be finally adjudged by a court of law invalid or unenforceable and the board of commissioners further finds that such provision constitutes at that time a consideration material to the continuance of the franchise granted under this chapter;

    (3)

    The grantee becomes insolvent, unable or unwilling to pay its debts, or is adjudged a bankrupt;

    (4)

    All or part of the grantee's facilities should be sold under an instrument to secure a debt and are not redeemed by the grantee within 30 days from such sale;

    (5)

    The grantee attempts to or does practice any fraud or deceit in its conduct or relations with the county under this franchise; or

    (6)

    The county condemns all of the property of the grantee within the county by the lawful exercise of eminent domain.
